Working with Disclosure Fulfillment Service
The Encompass Fulfillment Service provides manual fulfillment of disclosures where the lender physically sends initial disclosures via US Mail. This service enables lenders to ensure compliance with delivery of disclosures within three days of receipt of an application by detecting if a borrower has not yet viewed the document package electronically and sending that package to be printed, stuffed, and mailed to the borrower.
RESPA and RESPA-TILA regulations state that once a mortgage broker (or mortgage provider) receives an application or information sufficient to complete the application, the lender who agree to go forward on the application (or the mortgage broker) must provide the initial disclosures, including the Loan Estimate, to the borrower within three business days. The lender is responsible for determining whether the Loan Estimate has been provided.
After a loan team member sends the required initial disclosures to a borrower using the eFolder's eDisclosures option, the eDisclosure Fulfillment service automatically notifies them when the borrower fails to view the documents in the package electronically within a specified time. Lenders can schedule when the disclosures should be sent to print fulfillment when they send these disclosures electronically. In a scenario where borrowers do not access the disclosures electronically, manual fulfillment is triggered on the Scheduled Fulfillment date entered. If a lender opts to send the required disclosures via USPS mail, the regulation states that the disclosures must be shipped (not delivered) to the borrower within three days.
When the notification is sent, the eDisclosure Fulfillment service prepares a securely printed version of the disclosure package and sends it to the primary borrower on the date of your choice. The package is prepared by ICE Mortgage Technology and sent via the US Postal Service (USPS).
To set up the notifications you want the service to send and the date when the printed disclosure package should be prepared and sent to the borrower, you must first start the service, and then make your selections on the Send eDisclosures window that displays during the Send eDisclosure Documents process. To Start or Stop the eDisclosure Fulfillment Service:
By default, this service is turned off.

On the menu bar, click Encompass, and then click Settings.

On the left panel, click Additional Services, and then click eDisclosure Fulfillment.

To start the service, click the Start Service button located in the upper-right corner.

To stop the service, click the Stop Service button located in the upper-right corner.

Select or clear the Schedule Fulfillment Service for All Packages checkbox.

When the checkbox is selected, the Schedule a Fulfillment Service for this package checkbox is selected by default on the Send eDisclosures window when an Encompass user sends an eDisclosure package to the borrower.

When the checkbox is not selected, the Schedule a Fulfillment Service for this package checkbox is not selected by default in the Send eDisclosures window when a user sends an eDisclosure package. The user will have the option to select the Schedule a Fulfillment Service for this package checkbox themselves to schedule the Fulfillment Service when they send eDisclosures.

Select or clear the Skip Fulfillment if eConsent Accepted (Web Only) checkbox. This checkbox provides the option to skip disclosure fulfillment if the eConsent Agreement has been accepted when it is time to send the disclosures.

When this checkbox is selected, the eDisclosure Fulfillment service will not prepare or send the printed version of the disclosure package to the primary borrower when they fail to view the documents in the package electronically within a specified time if the borrower has accepted the terms of the eConsent Agreement.

When this checkbox is not selected, the eDisclosure Fulfillment service prepares and sends the printed version of the disclosure package to the primary borrower when they fail to view the documents in the package electronically within a specified time even if they have accepted the terms of the eConsent Agreement.
Important Notes:

This skip fulfillment option is applicable only to document flows ordered in the Encompass web interface or Encompass TPO Connect. This includes disclosures (web interface or TPO Connect), pre-closing docs (web interface), and the Request/Send option (web interface). Disclosures sent via the Send eDisclosures window after clicking the eDisclosures button in the eFolder in the desktop interface are not impacted by this new skip fulfillment option.

Note that even when this setting is set to skip fulfillment, users still have the option to not skip the fulfillment when needed. When the Skip Fulfillment if eConsent Accepted (Web Only) setting is selected, the system changes the Fulfillment default status to Off if eConsent has been accepted by all required parties. Users can still toggle the Fulfillment status to On if they want the disclosure package to be sent if the borrowers do not view the documents by the fulfillment date.
