Determining how "e" a mortgage transaction can be is based on three key factors:

  • investor approval,
  • insurability of title,
  • and recordability of the security instrument.

Simplifile’s eEligibility guidance is focused on the recordability of the security instrument. Section 17 of UETA provides that each government agency (including the recorder) may decide for themselves “whether and to what extent” they will rely on electronic records and signatures. Simplifile's daily interaction with recorders across the country provides us with granular insight into "whether and to what extent" each recording office will accept electronically signed and notarized documents for recording. This document provides a high‑level look at the most common scenarios we encounter when assisting our clients with their recordable documents.
