Encompass Docs Solution Uniform Instrument Update

In July 2021 it was announced that Fannie Mae had worked in collaboration with Freddie Mac to conduct a comprehensive review of their Uniform Instruments (Security Instruments, Notes, Riders and Addenda, and Special-Purpose documents) and made improvements to enhance their clarity and usability. Except for forms that are being retired by the GSEs at the end of 2022, these updates impact all Uniform Instruments. The GSE announcements from July 2021 can be found here:

Freddie Mac Uniform Instruments 2021 News & Updates

Per Fannie Mae and Freddie Mac (Government Sponsored Enterprises “GSEs”), lenders may begin using these updated forms immediately (July 2021), and are required to use them for loans with Note Dates [field L770] on or after January 1, 2023.

ICE Mortgage Technology and its Encompass Docs Solution (“EDS”) are creating these new documents as additions to our library and will continue to provide the older versions of these forms as well.

With the release of Encompass 22.2, we are making available Conventional Uniform Instruments. If you have not upgraded to Encompass 22.2 yet, you can still access these newest Uniform Instruments for testing purposes, however Encompass 22.2 does include new fields that the GSEs require for the generation of the DC Deed of Trust and WI Mortgage.

The Uniform Instruments being released are only those which Fannie Mae and Freddie Mac will continue to publish beyond the end of the year:

  • Fixed Rate First Lien (3200 series notes)

  • Adjustable Rate SOFR (3441 series notes/3141 rider)

  • Fixed/Adjustable Rate SOFR (3442 series notes/3142 rider)

  • TX Home Equity (3442.44 note/3142.44 rider)

2021 Updated Instruments - Freddie Mac Single-Family

EDS Program Codes will be automatically set to generate the new documents for loans with a Note Date [field L770] on or after January 1, 2023. This is regardless of which Encompass version you are using.

Impacted EDS Program Codes are:

  • 01400 - Conventional Fannie Mae/Freddie Mac Fixed Rate

  • 05050 - 30-Day Average SOFR 6 Month Adjustable (FNMA/FHLMC)

  • 05051 - 30-Day Average SOFR 6 Month Fixed/Adjustable (FNMA/FHLMC)

  • 05052 - Texas Home Equity 30-Day Average SOFR 6 Month Fixed/Adjustable (FNMA/FHLMC)

Should you need to generate the older versions of the documents instead, Encompass 22.2 includes the new Print 01/2001 Version of Uniform Instruments check box (field ID 4793) on the RegZ-CD and Closing RegZ screens. Select this check box to generate the older versions of the documents regardless of the Note Date. (Note that the check box is labeled “01/2001” because most of the Uniform Instruments had their last major updates applied by the GSEs in January 2001):

In lieu of using this check box, you can also submit an EDS Change Request to generate the older documents.

Updates to eNotes will be available later in 2022.

At this time, we encourage you to TEST and CONFIRM the Uniform Instruments being returned in your packages. Particularly for lenders who either use custom uniform instruments, or who have previously applied custom form selection to the generic uniform instruments, it is imperative that you confirm that the footer dates of the forms are not in conflict.
